In October, the Pennsylvania Land Trust Association refreshed one ConservationTools.org guide and its Model Release of Liability Form.
Refreshed Guide: Release of Liability Form: A Tool to Reduce the Risk of Claims for Personal Injury or Property Loss
Accidents happen and, when they do, claims for personal injury or property damage sometimes follow. Defending lawsuits is expensive and time-consuming. The defense may be ultimately successful and covered by insurance, but the costs are ultimately passed on to the insured through higher premiums. A properly designed release of liability form signed by a volunteer or participant in an activity can reduce liability risks of the organizing or hosting organization.
PALTA Updates Model Release of Liability Form
In October, the Pennsylvania Land Trust Association (PALTA) released the second edition of its Model Release of Liability Form (first edition, 2014), adding three new provisions to the core protections provided to activity sponsors against claims of personal injury:
- Emergency first aid and medical release
- Photo and video permission
- Protection from claims of personal property loss
The new edition also contains other miscellaneous improvements. Users are encouraged to adopt the new model immediately.
